1. Agreement to Terms

By downloading, installing, or using any mobile application developed by Rabbid Studio ("we", "our", or "us"), or by accessing our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our applications or services. These Terms constitute a legally binding agreement between you and Rabbid Studio.

2. Description of Services

Rabbid Studio develops and publishes mobile applications for iOS and other platforms. Our applications are made available through the Apple App Store and other distribution channels. The specific features, functionality, and availability of each application may vary. We reserve the right to modify, suspend, or discontinue any application or feature at any time without prior notice.

3. Eligibility

You must be at least 16 years of age (or the age of legal majority in your jurisdiction) to use our applications. By using our services, you represent and warrant that you meet this requirement. If you are using our applications on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

4. User Obligations

When using our applications, you agree to:

• Use the applications only for lawful purposes and in accordance with these Terms.
• Not reverse engineer, decompile, disassemble, or attempt to derive the source code of any application.
• Not remove, alter, or obscure any copyright, trademark, or other proprietary notices.
• Not use the applications to transmit any harmful, offensive, or illegal content.
• Not attempt to gain unauthorised access to our systems, networks, or other users' accounts.
• Comply with all applicable laws and regulations, including those of the European Union and your country of residence.

We reserve the right to suspend or terminate your access if we believe you have violated these Terms.

5. Intellectual Property

All rights, title, and interest in and to our applications, including but not limited to software, design, graphics, text, and other content, are owned by Rabbid Studio or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use our applications for personal or internal business use, subject to these Terms and the applicable app store terms. You may not copy, modify, distribute, sell, or lease any part of our applications without our prior written consent.

6. Privacy

Your use of our applications is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable laws. By using our applications, you consent to the practices described in our Privacy Policy.

7. Purchases and Subscriptions

Some of our applications may offer in-app purchases or subscriptions. Such purchases are processed by the applicable app store (e.g., Apple App Store). Payment terms, refunds, and cancellations are governed by the app store's terms and conditions. We do not control pricing or billing. For subscription-based applications, we will provide clear information about the subscription terms, renewal, and cancellation before you complete a purchase.

8. Disclaimers

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our applications will be uninterrupted, error-free, or free of harmful components. Your use of our applications is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rabbid Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our applications. Our total liability for any claims arising from or related to these Terms or our applications shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law (including consumer protection laws in the European Union).

10. Indemnification

You agree to indemnify, defend, and hold harmless Rabbid Studio and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our applications, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may terminate or suspend your access to our applications at any time, with or without cause or notice. Upon termination, your right to use our applications will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and indemnification.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union and the laws of the member state in which Rabbid Studio is established, without regard to conflict of law principles. For consumers residing in the European Union, you also benefit from the mandatory consumer protection provisions of your country of residence.

Any dispute arising from or relating to these Terms or our applications shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue resolution through the courts of competent jurisdiction. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we may provide additional notice through our applications or by email. Your continued use of our applications after such changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using our applications.
