End User License Agreement (EULA)

1. Introduction & Parties

This End User License Agreement ("Agreement" or "EULA") is a binding legal agreement between you (the "End-User") and Rabbid Studio ("we", "our", or "us").

By downloading, installing, or using any mobile application developed or published by Rabbid Studio (the "Application"), you acknowledge and agree that this Agreement is concluded between you and Rabbid Studio only, and not with Apple Inc. ("Apple"). Rabbid Studio, not Apple, is solely responsible for the Application and the content thereof.

2. Scope of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on any Apple-branded products (including iPhone, iPad, and iPod touch) that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions (the "App Store Terms of Service").

This license does not allow you to use the Application on any device that you do not own or control. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not copy, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Application.

3. Maintenance and Support

Rabbid Studio is solely responsible for providing any maintenance and support services with respect to the Application, as specified in this Agreement or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

4. Warranty

The Application is provided "as is" and "as available". Rabbid Studio is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

5. Product Claims

You acknowledge that Rabbid Studio, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to:

• Product liability claims;
• Any claim that the Application fails to conform to any applicable legal or regulatory requirement; and
• Claims arising under consumer protection, privacy, or similar legislation (including under the GDPR or HIPAA, if applicable).

6. Intellectual Property Rights

You and Rabbid Studio acknowledge that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, Rabbid Studio, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance

You represent and warrant that:

• You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and
• You are not listed on any U.S. Government list of prohibited or restricted parties.

8. In-App Purchases and Subscriptions

Certain features or content in the Application may be made available via auto-renewing subscriptions or one-time in-app purchases. If you purchase an auto-renewing subscription through the Apple App Store, the following terms apply:

• Subscription Period and Pricing: The specific subscription name, pricing, and duration (e.g., weekly, monthly, or annually) will be clearly presented to you within the Application prior to purchase.
• Auto-Renewal: Subscriptions automatically renew for the same price and duration period as the original subscription unless auto-renew is turned off at least 24 hours before the end of the current period.
• Billing and Renewal Charges: Payment will be charged to your Apple ID / iTunes Account at confirmation of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current subscription period, at the then-current price of the subscription.
• Subscription Management and Cancellation: You can manage your subscriptions, cancel them, or turn off auto-renewal at any time by going to your App Store Account Settings after making the purchase.
• Free Trials: If a free trial period is offered, any unused portion of the free trial will be forfeited when you purchase a subscription to that service, where applicable.

9. User Generated Content (UGC)

If the Application allows users to post, submit, publish, display, or transmit content (collectively, "User Generated Content" or "UGC"), the following rules apply:

• There is zero tolerance for objectionable, abusive, harassing, defamatory, or obscene content, or abusive users.
• You must not upload, share, or transmit any content that violates third-party rights, intellectual property laws, or applicable regulations.
• The Application provides built-in tools for users to flag/report objectionable content and block abusive users.
• Rabbid Studio will review all user reports and act upon them within 24 hours. Actions may include removing the offending content and/or terminating or suspending the account of the user who posted the content.

10. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application. For example, if the Application is a network-enabled app, you must not violate your wireless data service agreement (carrier terms) while using the Application.

11. Third-Party Beneficiary

You and Rabbid Studio acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

12. Termination

This Agreement is effective until terminated by you or us. Your rights under this license will terminate automatically without notice from us if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Application and destroy all copies, full or partial, of the Application.
